2. Terms of Sale and End-Consumer Reservation
By placing an order on our website, you agree to purchase a product subject to the following terms and conditions. All orders are subject to product availability, payment authorization, and price confirmation.
To enter into a contract with Daniel Essa, you must be over 18 years old and possess a valid credit or debit card issued by a bank acceptable to us. Daniel Essa reserves the right to refuse any order. If your order is accepted, you will be notified by email.
Products offered for sale are strictly reserved for direct sale to non-professional end-consumers (individuals or legal entities). The Customer agrees not to purchase products for resale in a commercial capacity.
a) Formation of the Contract
When you place an order, you will receive an acknowledgement email confirming that your order has been received. This email does not constitute acceptance of your order. A binding contract is formed only when you receive a shipping confirmation email notifying you that your items have been dispatched. The contract applies solely to the items listed in that confirmation email.
b) Pricing and Availability
We strive to ensure that all product descriptions, stock information, and pricing displayed on our website are accurate. However, errors may occur. If a pricing error is identified after you have placed an order, we will contact you as soon as possible and give you the option to reconfirm your order at the correct price or cancel it. If we are unable to reach you, the order will be cancelled and fully refunded if already paid. All prices displayed include VAT for orders shipped within the European Union (EU).
c) Shipping, Delivery, and Inspection
Delivery costs are calculated based on the destination country, the selected delivery method, the weight, and the type of items ordered. Depending on the shipping destination, complimentary standard shipping may be offered for orders exceeding a specific threshold. The exact shipping fees and any applicable complimentary shipping thresholds will be clearly displayed in your shopping bag and calculated at checkout prior to final order confirmation.
Where complimentary standard shipping applies, it is valid for orders containing up to three pairs of shoes. For orders exceeding three pairs — regardless of order value — Daniel Essa reserves the right to temporarily hold the shipment and contact the customer before dispatch. Due to the size, weight, or destination of the order, additional shipping charges may apply. The order will only be dispatched once these shipping conditions have been accepted by the customer. Daniel Essa reserves the right to cancel and refund any order for which the customer declines the proposed shipping terms.
Delivery estimates are provided for information purposes only and may be subject to delays caused by carriers or events of force majeure beyond our control. For more detailed information regarding delivery destinations, shipping options, and returns, please consult our dedicated Delivery & Returns page.
Address Errors and Absence: Daniel Essa cannot be held responsible for failed or delayed deliveries resulting from incomplete or inaccurate addresses provided by the Customer. In the event of a parcel returned for this reason, reshipment costs will be at the Customer's expense.
Package Inspection upon Delivery: It is the Customer's responsibility to inspect the condition of the packaging and product upon delivery. In case of a damaged or opened parcel, the Customer must write explicit handwritten reservations on the carrier's delivery slip and notify our Customer Care at info@danielessa.com within 3 business days.
Lost Parcels: In case of abnormal delays or suspected loss of a parcel by the carrier, an investigation will be launched with the shipping company. Refunds or reshipments will only be processed after official confirmation of definitive loss from the carrier.
d) Orders Outside the EU (Customs and Taxes)
For orders shipped outside the European Union, VAT (20%) is automatically deducted at checkout when you select the delivery country.
United Kingdom & United States: Prices displayed on the site include all taxes and customs fees. No additional duties will be charged upon delivery.
All Other Countries: Any applicable customs duties, import taxes, or local fees are the sole responsibility of the customer. These charges are set by the destination country's customs authorities and may vary according to local regulations.
If a customer refuses to pay local customs duties resulting in the return or abandonment of the parcel, shipping fees as well as any applicable customs duties incurred by Daniel Essa will be deducted from the total refund amount.
e) Payment
When you place an order, your payment card will undergo a standard pre-authorization check to ensure sufficient funds. No goods will be dispatched until this pre-authorization has been successfully completed.
f) Right of Withdrawal, Exchanges, and Refunds
In accordance with applicable regulations, you have the right to withdraw from your purchase or request an exchange within 14 days from the date you receive your items, provided the product is in its original, strictly unworn condition.
To exercise your right of withdrawal or request an exchange, you must contact our Customer Service within 14 days at info@danielessa.com. Upon authorization, we will provide you with a prepaid return shipping label.
Condition of Returned Items: Returned items must be in their original, unworn, unwashed, and unaltered condition, with all tags and original packaging included. For hygiene reasons, shoes must be tried on indoors on soft, clean surfaces with clean socks.
Shoebox Outer Packaging Requirement: The original shoebox is considered an integral part of the product. The shoebox must be placed inside a second protective shipping box for return dispatch. Returning an item without a second outer packaging, or with shipping labels affixed directly onto the original shoebox, will result in a mandatory deduction of €20 from your refund to cover packaging replacement costs.
Limitation of Subsequent Free Returns: Complimentary return shipping and exchanges are strictly limited to one (1) free return per order. For any additional return or exchange request originating from a non-EU destination (including the United States, Middle East, and Rest of the World) on the same order, a flat processing fee of €45 will be deducted from your refund (or billed prior to reshipment) to cover logistics, transport, and customs expenses.
Refund Terms: Approved refunds will be processed within 14 days of receipt and inspection of the returned goods, using the original payment method. If a purchase was paid fully or partially with a Daniel Essa E-Gift Card, the portion paid via gift card will be refunded in the form of store credit or a new gift card.
Archive Sales Exception: For purchases made during "Archive Sales" or special promotional archive events, return shipping costs are not covered by Daniel Essa. A fixed fee of €15 will be deducted from your refund to cover return transport expenses. Exchanges cannot be guaranteed for Archive Sale items due to limited stock availability.
3. Privacy Policy and Cookies
Our privacy policy, which sets out how we will use your information, can be found under section #16 below under “Detailed Privacy Policy”. By using this Website, you consent to the processing described therein and warrant that all data provided by you is accurate.
4. Website Use and Prohibitions
You agree to use this Website in compliance with applicable laws and regulations. Any abusive, fraudulent, or malicious use of the Site or its Services is strictly prohibited.
You are specifically prohibited from:
- Compromising the security or integrity of the Site (introducing viruses, hacking, attempting unauthorized access to servers or databases);

- Distributing unlawful, malicious, offensive material or content infringing upon third-party intellectual property rights;

5. Daniel Essa Gift Card
The Daniel Essa Gift Card (“E-Gift Card”) is a digital product intended for exclusive use on the official website danielessa.com. Purchasing, using, or possessing this card constitutes full acceptance of the conditions outlined below.
a) Nature of the Gift Card
The gift card is 100% digital and delivered by email. No physical card will be mailed. Daniel Essa cannot be held responsible for loss, deletion, or any error in the email address provided at checkout.
b) Validity
The gift card is valid for 12 months from the date of purchase. Once expired, it cannot be extended, reactivated, refunded, or exchanged. It is the responsibility of the customer or recipient to use the card within this period.
c) Terms of Use
- The gift card can be used exclusively on danielessa.com, up to the available balance.
- It may be used in one or multiple transactions, and combined with any other payment method accepted on the site.
- The gift card can be used during promotions, sales, and discount events, unless otherwise specified.
- The gift card cannot be used to purchase another gift card.
- A gift card can be used for multiple orders. For each order, the amount applied corresponds to the remaining balance on the card: the system automatically uses the maximum possible amount. If the order total is less than the balance, only the necessary portion is used, and the remaining balance remains available for future purchases until expiration.
d) Delivery Method
- If the buyer selects the option “I want to send this as a gift”, the card will be sent directly to the recipient’s email address.
- Otherwise, the gift card will be sent to the buyer’s own email address.
Daniel Essa cannot be held responsible for errors in the email address provided by the buyer.
e) Non-Refundable Nature
In accordance with applicable law, the gift card is non-exchangeable and non-refundable, even partially, in the event of loss, theft, expiration, or non-use. No right of withdrawal applies once the digital card has been dispatched.
Any purchase paid fully or partially with a gift card is strictly non-refundable in cash. In the event of a product return, the corresponding amount will be re-credited in the form of store credit or a new gift card.
f) Technical Issues
If a technical issue prevents the receipt or use of the gift card, the customer must contact customer support at info@danielessa.com. Daniel Essa will provide reasonable assistance to resolve the issue.
g) Fraud, Misuse, and Limitations
Daniel Essa reserves the right to suspend or cancel any gift card suspected of fraud, refuse a gift card used in violation of these terms, or request an alternative payment method if there is doubt regarding the origin or authenticity of the card.
h) Liability
Daniel Essa cannot be held liable for improper or unauthorized use of the gift card, delayed delivery caused by external factors (email filters, server issues), or the recipient’s inability to use the card before expiration.
i) Modification of Terms
Daniel Essa reserves the right to modify these terms at any time. The conditions applicable are those in effect on the date the gift card is purchased.
6. Intellectual Property
The intellectual property rights in all software and content made available to you on or through this Website remain the property of Daniel Essa or its licensors and are protected by copyright laws and treaties around the world. All such rights are reserved by Daniel Essa. You may store, print and display the content supplied solely for your own personal use. You are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on this Website, nor may you use any such content in connection with any business or commercial enterprise. You shall not modify, translate, reverse engineer, decompile, disassemble or create derivative works based on any software or accompanying documentation supplied by Daniel Essa.
